The ICC and Libya
"My Office continues to collect evidence in relation to a possible second case in Libya. No decision has yet been taken as to the focus of that second case. We continue to collect information on allegations of rape and sexual violence, which targeted both men and women; allegations against other members of the Al-Qadhafi Government for crimes committed during the events of 2011; and allegations of crimes committed by rebels or revolutionary forces, including against the residents of Tawergha, individuals hors de combat and detainees. I will take a decision on the direction of a possible second case in the near future.” - ICC Chief Prosecutor Fatou Bensouda speaking on the civil war in Libya.
The ICC has stated that the rebel forces i Lybia, if in breach of international law just as the Gaddafi regime will be held accountable for its actions.
So far any prosecution of the people of Lybia or supporters of Gaddafi has not happened. This is because the Lybian rebels are refusing to cooperate with the ICC and so they cannot prosecute. Their lack of cooperation is most likely because they wish to execute the Gaddafi regime rather than having them locked up, so before the ICC has any influence over the decisions made in Lybia they execute their prisoners just as they executed Gaddafi himself.
The ICC has not arrested any of the Lybian rebels.
